TERMS & CONDITIONS AGREEMENT
This Agreement is entered into by and between Traverse City Picnics (“Company”) and the Client (“Client”). By booking services or using our website (www.traversecitypicnics.com)(http://www.traversecitypicnics.com), you agree to be bound by the following Terms & Conditions.
1. Agreement
Welcome to Traverse City Picnics. Traverse City Picnics is a luxury picnic and event styling service providing curated outdoor experiences in and around Traverse City, Michigan.
2. Services
By booking with Traverse City Picnics, you are hiring us to design, set up, and style a luxury picnic or event experience for your selected date, time, and location. All bookings are subject to availability and confirmation.
3. Cancellation & Rescheduling Policy
Standard Policy (Non-Weather Related): All bookings are non-refundable. You may reschedule your event with at least 7 days’ notice prior to your event date. Rescheduled events must occur within 90 days of the original booking date. Rescheduling is subject to availability.
4. Weather Policy
Outdoor events are inherently weather-dependent. The following policy applies:
4.1 Rain Determination: Weather is evaluated using the National Weather Service forecast for your event location. Determination is made at 6:00 PM the evening before your event. “Measurable rain” is defined as ≥ 0.01 inches during your event window. All determinations are made at our sole discretion.
4.2 Client Options (Forecasted Rain): If measurable rain is forecasted: Reschedule to any available date within 90 days, OR cancel for a refund minus a 4% processing fee if written notice is provided at least 72 hours prior, OR if less than 72 hours’ notice: refund will be issued minus 4% processing fee AND any vendor/catering costs already incurred.
4.3 Vendor & Catering Orders: Orders are typically placed 72 hours before your event. Once placed, they are non-refundable, non-transferable, and cannot be applied to rescheduled bookings.
4.4 Non-Qualifying Weather: The following do not qualify for rescheduling or refunds: cold temperatures, wind, fog, overcast conditions, heat, air quality, personal preference. These are treated as voluntary cancellations.
4.5 Weather After Setup: Once your picnic has begun, no refunds or rescheduling will be issued due to unexpected weather changes.
4.6 Company-Initiated Rescheduling: We reserve the right to reschedule if conditions pose a risk to equipment, staff, or guest safety. Rescheduled events will occur within 90 days. Refunds will not be issued in this case.
5. Late Arrival & Event Timing
Your event begins at the scheduled booking time. A 15-minute grace period is included. For late arrivals: 15–30 minutes late: $75 late fee. 30+ minutes late: staff will leave after setup, setup remains available for your reserved time, and no refunds or extensions will be provided. Additional time is available at $150/hour, subject to availability.
6. Property Damage & Responsibility
You agree to treat all equipment and property with care and be financially responsible for any damage caused by you or your guests. You will be charged for repairs, replacement costs, and cleaning fees if necessary.
7. Waiver & Release of Liability
By participating in our services, you acknowledge and agree that you assume all risks associated with outdoor activities and event participation. Traverse City Picnics is not liable for any injury, sickness, disease (including resulting in death) of any persons, or the loss or damage to personal property (including loss of). You agree to release and hold harmless Traverse City Picnics from any claims arising from your participation. You are responsible for your own medical expenses and are encouraged to carry personal insurance. Traverse City Picnics shall, at its sole option and discretion, have the right to terminate this Agreement for any reason whatsoever by providing you with a Notice of Termination prior to the event. We will contact you by phone, registered mail, and/or email.
8. Indemnification
You agree to indemnify and hold harmless the Property Owner, Traverse City Picnics and any agents and employees from any liability, claims, suits, damages, or legal fees arising from your use of services, your violation of these terms, and actions of you or your guests.
9. Electronic Communications
By using our website or communicating with us electronically, you consent to receive communications via email or digital formats.
10. Intellectual Property
All content on our website, including images, branding, designs, and text, is the property of Traverse City Picnics and may not be used without written permission.
11. Third-Party Services
We may utilize third-party vendors (e.g., catering, florals). We are not responsible for third-party performance, delays, or issues beyond our control.
12. Alcohol Policy
Traverse City Picnics does not provide, serve, or sell alcoholic beverages. We are happy to offer guidance during the planning process and may suggest alternative locations based on your preferences; however, all alcohol-related decisions and compliance are the sole responsibility of the Client.
12.1 Public Park Restrictions: In accordance with local regulations in Traverse City: only beer and wine are permitted in most City parks. Alcohol is not permitted in the following locations: American Legion Park, Clinch Park Beach, F & M Park, Hannah Park, Hickory Hills, Hull Park, J. Smith Walkway, Lay Park.
12.2 Glass Container Restrictions: Glass containers are strictly prohibited in any water area and any land designated for swimming or beach use.
12.3 Client Responsibility: The Client and all Guests are solely responsible for understanding and complying with all local laws and regulations, ensuring alcohol is consumed legally and responsibly, and any fines, penalties, or legal issues resulting from alcohol use. Traverse City Picnics assumes no liability for alcohol consumption, guest behavior related to alcohol, or violations of local laws or ordinances. Traverse City Picnics reserves the right to end an event without refund if unsafe or unlawful behavior related to alcohol occurs.
13. Park Permits & Public Space Use
Many public parks and outdoor spaces in Traverse City and surrounding areas may require permits, reservations, or prior authorization for gatherings, events, or commercial setups.
13.1 Client Responsibility: The Client is solely responsible for determining whether a permit is required for their selected location, obtaining and paying for any required permits, reservations, or approvals, and complying with all local rules, ordinances, and park regulations. This includes (but is not limited to) city parks, beaches, public waterfront areas, and state or county-managed land.
13.2 Permit Coordination: If Traverse City Picnics agrees in writing to assist with permit coordination, the Client remains financially responsible for all permit fees, approval is not guaranteed, and delays or denials are outside of our control.
13.3 Failure to Obtain Permits: If a required permit is not obtained, the event may not be set up or may be required to end early. No refunds will be issued. Rescheduling will be treated as a standard reschedule request and subject to availability.
13.4 Liability: Traverse City Picnics is not responsible for fines, citations, or penalties, event shutdowns by authorities, or restrictions imposed by park officials or law enforcement. All such matters are the sole responsibility of the Client.
14. Governing Law
These Terms are governed by the laws of the State of Michigan. Any disputes shall be resolved within Michigan.
15. Arbitration
Any disputes arising from these Terms shall be resolved through binding arbitration in Michigan, in accordance with applicable laws.
16. Limitation of Liability
To the maximum extent permitted by law, Traverse City Picnics shall not be liable for any indirect, incidental, or consequential damages. Your sole remedy is to discontinue use of our services.
17. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of any changes.
